Terms of Use
Welcome to ClearDiagnosis. These Terms of Use (“Terms”) govern your access to and use of the ClearDiagnosis website, mobile application, platform, and related services (collectively, the “Platform”) operated by ClearDiagnosis (“ClearDiagnosis,” “we,” “our,” or “us”). By creating an account, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.
1Purpose of the Platform
ClearDiagnosis is a technology-enabled platform designed to facilitate physician review services and related administrative and operational functions. The Platform allows users to upload medical records and related health information, request physician review services, communicate electronically through secure channels, and receive physician-generated assessments, impressions, recommendations, or opinions.
The Platform may utilize software tools, including artificial intelligence-assisted functionality, to help organize, summarize, prioritize, or present information for physician review. These tools are intended solely to support physician workflow and information management and are not intended to independently diagnose medical conditions, determine treatment, or replace physician judgment.
Clinical services made available through the Platform are provided by licensed physicians exercising independent professional judgment.

3No Replacement for Treating Providers
The Platform is not intended to replace your existing physicians or healthcare providers. You should continue to maintain relationships with your treating providers and should not disregard, delay, or discontinue medical advice from your treating providers based solely on information obtained through the Platform. Any physician review, assessment, impression, recommendation, or opinion obtained through the Platform should be considered together with advice from your treating healthcare professionals.
4Physician Services
Physician review services provided through the Platform are rendered by licensed physicians exercising independent professional judgment based on the information available to them. Physician opinions, assessments, impressions, or recommendations may be limited by incomplete, inaccurate, outdated, or unavailable information submitted through the Platform.
ClearDiagnosis does not guarantee that any physician will accept or review a particular case, provide any specific recommendation or opinion, or achieve any particular clinical outcome. Medicine involves uncertainty, and physician opinions provided through the Platform may differ from the opinions of your treating healthcare providers or from opinions provided by other physicians.
Physicians reviewing information through the Platform may consider information submitted by users together with Platform-generated summaries, organizational tools, or analytical support features. Physicians remain solely responsible for independently evaluating available information and exercising their own professional judgment regarding any clinical opinions, assessments, or recommendations they provide.
5Artificial Intelligence and Software-Assisted Functionality
The Platform may incorporate software-assisted tools, including artificial intelligence or machine-learning-enabled functionality, to support information management and physician workflow. These tools are intended solely to assist in organizing, summarizing, prioritizing, or presenting information and are not intended to replace physician judgment, independently establish diagnoses, or determine treatment decisions.
Software-generated outputs may contain inaccuracies, omissions, errors, or incomplete information. By using the Platform, you acknowledge and agree that software-assisted outputs may not always be accurate or complete, that physicians may agree or disagree with software-generated information, and that medical decision-making should not rely solely on automated outputs. Physician review and independent professional judgment remain essential components of the review process.
6User Responsibilities
You agree to provide accurate, current, and complete information when using the Platform. You are responsible for ensuring that any medical records, reports, histories, images, questionnaires, or other information you provide are complete and accurate to the best of your knowledge. Incomplete or inaccurate information may affect the usefulness, quality, or accuracy of any physician review performed through the Platform.
You agree to use the Platform only for lawful purposes and only in accordance with these Terms. You may not submit information that you are not authorized to provide, interfere with the operation or security of the Platform, attempt unauthorized access to systems or accounts, upload malicious materials, impersonate another individual, or otherwise misuse the Platform.
7Eligibility
You must be at least eighteen (18) years old to use the Platform unless use is authorized by a parent, legal guardian, or legally authorized representative. By using the Platform, you represent and warrant that you are legally permitted to use the Platform, that you have authority to provide the information submitted through the Platform, and that you will comply with all applicable laws and regulations.
8Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You agree to notify ClearDiagnosis immediately of any unauthorized use of your account or any security breach involving the Platform.
9Electronic Communications
By using the Platform, you consent to receive electronic communications from ClearDiagnosis and participating healthcare professionals, including messages delivered through the Platform, emails, text messages, appointment notifications, and administrative communications. Standard message and data rates may apply. You acknowledge that electronic communications may not always be secure outside the Platform environment and that there are inherent risks associated with transmitting information electronically.
9ASMS Messaging for Multi-Factor Authentication
Program. If you provide your mobile phone number and opt in, ClearDiagnosis will send you SMS or text messages solely to deliver one-time verification codes used for multi-factor authentication (“MFA”) to help secure your account. ClearDiagnosis does not use SMS for marketing, appointment reminders, case updates, physician communications, or other promotional or service notifications.
How you opt in
You opt in to receive MFA SMS messages by entering your mobile phone number on the ClearDiagnosis MFA setup page and submitting it. By providing your number and opting in, you confirm that you are the subscriber or customary user of the number provided and that you authorize ClearDiagnosis to send recurring one-time MFA verification codes to that number, including codes sent using an automated system.
Message frequency & rates
Message frequency depends on your sign-in activity. You will typically receive a verification code each time you sign in or perform a security-sensitive action. Message and data rates may apply — check your mobile plan for details. ClearDiagnosis is not responsible for charges imposed by your mobile carrier.
Opt out (STOP) & help (HELP)
You may cancel SMS messages at any time by replying STOP to any message you receive from us. After you reply STOP, you will receive one final confirmation message, and no further SMS messages will be sent unless you opt in again. If you opt out of SMS-based MFA, you may not be able to access your account via SMS verification; please contact info@cleardiagnosis.com to arrange an alternative authentication method. Reply HELP to any message for assistance.
Carriers & privacy
Supported carriers include all major U.S. mobile carriers. Carriers are not liable for delayed or undelivered messages. Information collected in connection with the MFA SMS program is handled in accordance with the ClearDiagnosis Privacy Policy. No mobile information or SMS opt-in consent will be shared with third parties or affiliates for marketing or promotional purposes.
Subscribers will opt-in via www.cleardiagnosis.com to receive verification messages from ClearDiagnosis, powered by AWS Notify. Message frequency may vary per user. Text “HELP” for help. Text “STOP” to cancel. Message and data rates may apply for any messages sent to you from us and to us from you. Carriers are not liable for delayed or undelivered messages. 10Privacy
Your use of the Platform is also governed by the ClearDiagnosis Privacy Policy, which is incorporated into these Terms by reference.
11No Guarantee of Outcomes
ClearDiagnosis does not guarantee diagnostic accuracy, treatment recommendations, physician availability, clinical improvement, or that use of the Platform will meet your expectations or needs. Physician opinions obtained through the Platform may differ from one another or from the opinions of your treating healthcare providers.
12Platform Availability
ClearDiagnosis may modify, suspend, discontinue, or restrict access to any part of the Platform at any time and without liability. We do not guarantee uninterrupted or error-free operation of the Platform.
13Intellectual Property
The Platform, including its software, functionality, design, content, text, graphics, trademarks, logos, and other materials, is owned by or licensed to ClearDiagnosis and is protected by applicable intellectual property laws. Except as expressly permitted by law, you may not copy, reproduce, distribute, modify, reverse engineer, scrape, or create derivative works from the Platform or its content.
14Third-Party Services
The Platform may integrate with or provide access to third-party services, applications, or websites. ClearDiagnosis is not responsible for the availability, content, policies, or practices of third-party providers and does not endorse third-party services unless expressly stated.
15Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR DIAGNOSIS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY. CLEAR DIAGNOSIS DOES NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE, THAT THE PLATFORM WILL ALWAYS BE AVAILABLE, THAT SOFTWARE-ASSISTED OUTPUTS WILL BE ACCURATE OR COMPLETE, OR THAT ANY DEFECTS WILL BE CORRECTED.
16Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEAR DIAGNOSIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, LICENSORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, RELIANCE ON INFORMATION PROVIDED THROUGH THE PLATFORM, SOFTWARE-ASSISTED OUTPUTS, PHYSICIAN REVIEW SERVICES, PLATFORM INTERRUPTIONS, OR UNAUTHORIZED ACCESS TO DATA.
